deef.ca Terms and Conditions
PART I:
GENERAL TERMS AND CONDITIONS
1. Acceptance of Terms
By accessing and using the services provided by deef.ca and its parent company, Bussière Organizational and Leadership Consulting Limited (“Bussière Organizational”), (hereinafter referred to as the “Services”), you are agreeing to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Services.
2. Account Creation and Management
To use our Services as a “Registered User” (with the ability to create and distribute quesitonnaires), you will be required to create an account. You agree to provide accurate information and to keep this information up-to-date. You are responsible for maintaining the security of your account and for all activities that occur under your account.
We reserve the right to “tidy” your account by removing questionnaires (and associated response data) after six-months of closure. Once removed, questionnaire data is no longer available to you. Prior to removal, we encourage you to download and secure a personal copy of your questionnaire data in .csv format using the process provided.
To use our Services as a “Questionnaire Participant” (with the ability to answer standard- or quiz-type questionnaires distributed by Registered Users), you will not be required to create an account. By participating in a questionnaire, you agree and consent to the collection and use of your intellectual property (question responses), and withdraw any and all past, present, and future claims for economic or other forms of compensation.
3. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms and Conditions, explains how we collect, use, and protect your personal information.
4. Payment Terms and Refund Policy
As a Registered User, and by creating an open (or pending) questionnaire, you agree to pay the stated fee of CAN$0.35 (Canadian currency [≈ US$0.25; ≈ EU€0,25; ≈ AU$0.40; ≈ NZ$0.40; < ZA R5]) per credit unit. Each credit unit provides you with one question per three days, or portion thereof, that will be accessible by your participants through access to a standard- or quiz-type questionnaire. Credit units are sold in multiples of 20 and a user may purchase between 20 and 200 credit units in any given payment transaction. All payments are non-refundable, and questionnaires automatically close after three calendar days. If a closed questionnaire is reopened, additional credit units / fees will apply in accord with the above. Questions within quesitonnaires marked as pending are considered open for the purposes of payment. Questions within pending questionnaires that are closed before opening are considered to have been opened for the purposes of payment.
Complimentary credit units issued from time to time to a Registered User are considered idential to credit units purchased. While such complimentary credit units do not have an expiration date, once used, they will be deducted from the Registered User’s account.
Questionnaire Participants are not required to pay to use our service.
5. Intellectual Property Rights
All intellectual property rights to the Services, including but not limited to design, text, graphics, logos, and software, belong to deef.ca and Bussière Organizational.
6. Registered User Conduct and Obligations
As a Registered User and/or as a Questionnaire Participant engaged in the use of our Services, you agree not to misuse the Services or to assist others in doing so. You must comply with all applicable laws and regulations, respect the rights of others, and refrain from behavior that is unlawful, abusive, or offensive.
7. General Limitation of Liability
deef.ca, Bussière Organizational, and its representatives shall not be liable for any direct, indirect, special, consequential or punitive damages, including but not limited to loss of use, profit, data, or other intangible losses, related to the use or inability to use our Services.
8. Termination of Service
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice.
9. Changes to the Terms
We may modify these Terms and Conditions at any time. We encourage you to regularly review these Terms and Conditions on the current page of our website (https://deef.ca/terms.php) to stay informed about any changes.
As a Registered User, if such modifications require communication with you to disclose amendments that would affect your rights, we will present you with certain choices meant to fulfill obligations and mediate risks that may have otherwise arisen under the predecessor terms and conditions.
Due to the anonymous nature of questionnaire participation, we are unable to communicate with Questionnaire Participants. Questionnaire Participants are advised to regularly review these Terms and Conditions, as per above.
10. No Warranty
deef.ca and its parent company, Bussière Organizational, offer no warranty, either implied or expressed, of any kind, as to the availability, reliability, continuity, or functionality of the servers hosting the Services.
deef.ca has been designed for optimal use on a personal computer with access to the internet. deef.ca is not responsible for providing internet or personal computer services or support. Portions of the Services may be unavailable on mobile devices due to technological and other limitations.
Servers hosting the Services, which are managed and operated by a third-party hosting service provider, may be inaccessible, unavailable, or inoperable at any time and for any duration due to routine maintenance, system updates, network issues, equipment failure, unforeseen circumstances, or other factors beyond our control. We are not responsible for any loss, damage, or inconvenience, whether direct or indirect, resulting from the inability to access the servers at any time.
Furthermore, deef.ca and Bussière Organizational disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the servers, as run by the third-party provider, will be error-free, uninterrupted, or free of viruses or other harmful components.
In no event shall deef.ca, Bussière Organizational, its directors, officers, employees, agents, or affiliates be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from the loss of use, data, or profits, whether in an action of contract, negligence, or other tortious action, arising out of or in connection with the use or performance of the servers.
This disclaimer applies to the maximum extent permitted by applicable law and shall remain in full force and effect even if any remedy fails of its essential purpose.
By using the services provided by deef.ca and Bussière Organizational as either a Registered User and/or as a Questionnaire Participant, you agree to this disclaimer and release deef.ca and Bussière Organizational, and all of its representatives, from any and all liability, claims, actions, demands, costs, or damages related to server access. Please consult with a professional if you need legal advice regarding this disclaimer.
11. Feedback Event/Questionnaire Content
As a Registered User hosting a feedback event and/or questionnaire, you are solely responsible for all the content of the event or questionnaire, including any questions or responses. You agree to ensure that your content does not violate any laws, infringe on any rights of third parties, or contain libelous, defamatory or otherwise malicious material.
If, as a Registered User, you choose to display the results (or any collected data) of any questionnaire to any other individual (including questionnaire participants), you agree to accept and assume full responsibility and liability for any direct, indirect, special, consequential or punitive damages, including but not limited to loss of use, profit, data, or other intangible losses to you or any other individual or entity.

12. Use of Services for the Purpose of Research or Scientific Study
As a Registered User, you acknowledge that the use of our Services for the purposes of research, academic or any other scientific study or endeavour must be conducted in accordance with all applicable laws, regulations, national or institutional ethical guidelines, standards, and best practices.
If you engage in any unethical conduct, misrepresentation, or any other breach of ethical standards in connection with the use of our Services, including but not limited to the display, collection, or dissemination of questionnaire results or any other data, you agree to accept and assume full responsibility and liability for any direct, indirect, special, consequential, academic or punitive damages that may arise. This includes, but is not limited to, loss of use, profit, data, or other intangible losses to you or any other individual or entity, whether or not we or they have been advised of the possibility of such damages.
When the Services are used for the purposes of research, academic, or other scientific study, we strongly advise you to consult with your institution’s Research Ethics Board, Office, or Authority and we strongly advise you to follow any advice or guideline they offer with respect to the use of our Services for such purposes.
13. Payment Processing
All payments made through our Services are processed by a third-party payment processor. By making a payment, as a Registered User you agree to provide accurate, current, and complete payment information. You further agree that your payment information will be shared with our third-party payment processor. We do not directly access, handle, or store your credit card information. For more information about how payment information is processed and stored, please refer to our third-party payment processor’s terms of service and privacy policy at the time your payment is made.
14. Indemnification
You agree to indemnify and hold deef.ca, Bussière Organizational, its directors, officers, employees, agents, and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the Services or any breach of these Terms and Conditions.
15. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the Canadian province of Saskatchewan. Any disputes arising from these Terms and Conditions shall be resolved through arbitration in the same jurisdiction.
PART II:
PRIVACY POLICY
1. Acceptance of Terms
By accessing and using the Services provided by deef.ca and its parent company, Bussière Organizational, you are agreeing to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, please do not use the Services.
2. Information We Collect
We may collect and process the following types of information:
Personal information (such as name, email address, timezone) that you provide by completing forms on our site, including if you register as a user of our Services, subscribe to any service, upload or submit any material via our site, or request any information;
Communications you send to us, for example to report a problem or to submit queries, concerns, or comments regarding our site or its content;
Information from surveys that we may, from time to time, conduct on the site that we use for research purposes, if you choose to respond to them;
3. Use of Registered User and Questionnaire Participants’ Information
The information we collect will be used for the purposes specified in this policy or on the relevant pages of our website. We may use Registered Users’ personal information to:
Administer our site and for internal operations, including troubleshooting, data analysis, testing, statistical, and survey purposes;
Improve our site to ensure that content is presented most effectively for you and your computer;
Enable your use of our Services;
Send you non-marketing communications;
Notify you about complimentary or compensatory credit units added to your account.
When Questionnaire Participants visit our site, we don’t ask for any personal information. As is the case for all websites, servers used by deef.ca and Bussière Organizational record the IP address of each computer that accesses them over the internet. The date- and time-reliant nature of this site means that we may be required to collect and use Questionnaire Participants’ current timezone for date- and time-related analyses.
4. Disclosure of Your and Your Participants’ Information
We will not share your personal information with any third parties for the purpose of direct marketing. We may disclose your information in the following circumstances:
If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of service and other agreements;
To protect the rights, property, or safety of us, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction;
We may use collected IP addresses and timezones from Questionnaire Participants for internal deef.ca and Bussière Organizational quality control, and to help ensure the proper function and security of our site. Without any further data, IP addresses and timezones alone don’t tell us who your participants are—and we can’t pass any information about them on to any Registered User or other Questionnaire Participant. The data provided by Questionnaire Participants will always be presented as anonymous to Registered Users as the designer and host of questionnaires or other feedback events.
5. Security
We will take reasonable technical and organizational precautions to prevent the loss, misuse, or alteration of your personal information. We will store all the personal information you provide on secure servers.
6. Your Rights
You have the right to ask us not to process your personal data for marketing purposes. We will inform you (before collecting your data) if we intend to use your data for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data, should such a purpose become muturally beneficial.
7. Updates to this Policy
We may update this privacy policy from time-to-time by posting a new version on our website. You should check this page occasionally to ensure you understand any changes to this policy. If such updates require communication with you to disclose modifications that would affect your rights, we will present you with certain choices meant to fulfill obligations and mediate risks that may have otherwise arisen under the predecessor policy.

Like any other website, deef.ca uses “cookies” and “web beacons” or similar technologies and techniques. These are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize our Registered Users’ and Questionnaire Participants’ experiences by customizing our web page content based on visitors’ browser type and/or other information.
10. Third-Party Privacy Policies
deef.ca’s Privacy Policy does not apply to other advertisers, payment processors, or other websites. Thus, we advise you to consult the respective Privacy Policies of these third-party ad servers and other providers for more detailed information. It may include their practices and instructions about how to opt-out of certain options.
11. Children’s Information
We encourage parents and guardians to observe, participate in, and/or monitor and guide their children’s online activity. deef.ca does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will make our best efforts to promptly remove such information from our records should doing so be desirable to you.
12. Jurisdiction
This Privacy Policy is governed by and interpreted according to Canadian law and more specifically the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Freedom of Information and Protection of Privacy Act (FOIP) of Saskatchewan. Any disputes must be resolved by the courts of Saskatchewan.
